When we work together you get me. You know when I decide that I believe in you and your story that I work like I own stock in you. I will move mountains for you and go to war for you. That might sound strange and maybe it is strange for a company to believe so hard in you that they give it their all, every ounce of expertise, will and life experience.
So I want you to consider a few things…
When It comes to COLOR…
I can not help you if you are looking at things on your PC, then on your iphone and then on a print out off your inkjet and want to know why the colors look different. All I can tell you is that due to differences in monitor and printer calibration, the color of the printed piece may vary from what you see on screen or what prints on your printer and it might be totally different that a professionally printed piece using processed or pantone inks. So please don’t ask me to correct the colors so they all match. I work on a calibrated Mac, I design for the end piece, print or screen.
It’s about TIME!
Time is something we can not make more of. Please be respectful of mine as I am of yours. I only take on a few clients every month. I do not over schedule like a doctors office or the airlines.
I know this sounds harsh but …
Keep in mind, agreeing to work with me, accepting the quote and then showing up hours late for our meetings is not nice. Neither is just dropping in so I can “look at something” unrelated to what we are working on. If it becomes an issue I will bill accordingly.
Lastly just because my studio is in my home, I happen to like working surrounded by my dogs and antiques, it doesn’t mean I will watch your sick kid, run errands for you, or be interested in the tv show you’re watching…

Hurry, Hurry, Hurry RUSH FEES
Just because I make it look easy doesn’t mean it is. I have years of experience but no project is ever a coookie-cutter-pop-it-in-the-mold quick and easy thing. So, pending my schedule, rush jobs may be accomplished for an additional fee.
PROOF READING
Please, please, please review all names, addresses, phone numbers, websites, and other important information. I am not responsible for errors found after the designs have been approved; accuracy of the information is your responsibility.
STOCK PHOTOGRAPHY
Purchase of stock photography is additional. All purchases will require written authorization.
SUPPLIED ARTWORK
Quality and usage licensing of art you supply is your responsibility.
Original ARTWORK RELEASE
If Any original artwork is created by me and you wish a release, there will be an artwork release fee of 25% the total design or a minimum of $500. The original artwork remains copyrighted to FR Trendler.
COPYRIGHT
Reproduction rights to the Client is conditioned upon receipt of payment in full. I shall reserve all rights not expressly granted. I will retain the right to make reproductions for our portfolio, samples, self-promotion, professional competition and review, and website even if the artwork release has been purchased.
WEBSITES
Websites may include a small “Designed by FR Trendler” note in the footer with a link to our website unless removal is specifically requested by the Client. While I create all designs, programming services may be delegated to another firm or independent contractor.
CHANGES
Any changes you think you may want after that mock-ups have been approved must be presented in writing.Then we’ll schedule a meeting to discuss if the changes fit the desired outcome of the project, if they reflect the the project’s purpose and lastly if the changes will affect the budget quoted for the project.
CANCELLATION FEES
All orders are subject to cancellation fees: 100% design fee for any work that has been done; 100% design plus 15% of the total printing price if the job has been sent to print but not yet printed; 100% of the invoice amount if the job has already printed. Jobs placed on hold for over 30 days will be considered cancelled and cancellation fees will apply. If you choose to reopen the order within 30 days from the invoice date showing cancellation, the applicable fees will be credited to the completion of your reopened projects.
PAYMENTS AND LATE FEES
A retainer of $100 is required before the client consultation. The retainer will be applied towards the last payment of the project. A quote will be provided with-in 5 business days of the consultation outlining the project’s scopes and needs. Payment of 50% of the project is expected to initiate production*. Depending on the length of the project additional payments will be aligned with milestones. I must receive final payment within 5 business days of the final invoice date.
Any project under $400 must be paid in full before work begins.
Invoices are sent as attachments by email.
A late fee of $25 or 1% total invoice amount (whichever is greater) will be applied on the first day of each week past 30 days from invoice date. I am not responsible for payments claimed to be lost in the mail, sent to the wrong address, or otherwise not received. You will be charged for any bank fees due to bounced checks plus $80 and will be responsible for late fees accrued over the time that the check was in the banking system. If payment is not received after 60 days of the original invoice date, we will pursue legal action or collection agencies to receive payment..
INDEMNIFICATION
You agree to indemnify, defend and hold harmless me, FR Trendler, my independent contractors, affiliates, agents, employees, partners, and suppliers from any liability, loss, claim, demand, and expense (including attorneys’ fees) related to any artwork or programming that you supply or approve. I reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which you will cooperate with us to the fullest possible extent.
RIGHT OF WITHDRAWAL
I reserve the right to withdraw from a project if the client misses multiple appointments; if the client’s checks are returned or if payments are consistently late. Should I initiate the withdrawal, all fees and payments will be returned, excepting fair market value for all services/products already provided. In case of withdrawal, $80 per hour is billed for all design services already provided, consultations, and all drive time, rounded up to the nearest half-hour.
DISPUTES
I operate in Tennessee in the United States of America. The laws of the State of Tennessee will govern the legal notices and conditions of use without giving effect to any principles or conflicts of laws. I retains the right to take legal action if this Agreement is violated, and in such case, if I prevails, the Client is solely responsible for any and all mediation, arbitration, and legal fees incurred by me and my studio.
SEVERABILITY
In the event that any provision of this Agreement is held invalid by any tribunal of competent jurisdiction, the remaining provisions of this Agreement shall not be held invalid and shall remain in full force and effect.
ENTIRE AGREEMENT
This contract constitutes a full and complete Agreement between the parties. There are no oral or other Agreements that supersede this Agreement. This Agreement describes the terms and conditions applicable to the services available by myself. This Agreement describes the Client’s responsibilities and, among other things, limits the liability of Myself. The Client will be fully responsible for ensuring that full payment is made pursuant to the terms of this Agreement.
